Approval of a Special Immigrant Juvenile petition does not automatically grant a green card, employment authorization, or permission to travel. The next step depends on immigrant visa availability, eligibility for adjustment of status, and the person’s immigration history.
Understand which stage was approved
A state juvenile-court order, an approved Form I-360, and an approved Form I-485 serve different purposes. The court order supports the SIJ petition. I-360 approval establishes the SIJ classification. Form I-485 is the separate application for lawful permanent residence. Confirm which document you received before making plans based on an “approval.”
USCIS explains the adjustment process on its SIJ green-card page. Special adjustment rules appear in 8 CFR 245.1(e)(3). They do not eliminate every eligibility or admissibility issue.
Check visa availability using two separate questions
SIJ cases fall within the employment-based fourth preference, EB-4. Locate the correct priority date in the USCIS notices and compare it with the applicable country-of-chargeability column and EB-4 row of the Department of State Visa Bulletin.
- Can the application be filed? Check which chart USCIS permits employment-based applicants to use for the month the application will be filed.
- Can permanent residence be approved? Visa availability under the applicable final-action rules must also permit approval.
A Dates for Filing entry is not permission to file with USCIS unless USCIS has authorized that chart for the relevant month. The USCIS monthly chart-selection page must be checked separately. When a cutoff date is listed, a priority date must generally be earlier than that date; equality is not enough. Dates can move forward or backward.
What if you have an immigration court case?
Give counsel every hearing notice, court order, and prior immigration decision. An approved I-360 does not by itself cancel a removal order or end court proceedings. The filing authority, any necessary court steps, and possible enforcement consequences must be evaluated from the actual procedural history.
Can you apply for a work permit?
A person with a properly filed adjustment application may qualify to apply for employment authorization using Form I-765 under category (c)(9). That category appears in 8 CFR 274a.12. Filing the request does not itself authorize employment; authorization must actually be in effect.
I-360 approval alone should not be treated as a work permit. If adjustment cannot yet be filed, any separate deferred-action or employment-authorization basis must be checked under the current policy and the individual notices. Do not rely on an older article promising an automatic benefit to every approved SIJ.
Can Form I-131 be filed with I-485?
An eligible adjustment applicant may request advance parole using Form I-131. Eligibility and approval require separate consideration. Filing I-131 does not permit departure, and an approved SIJ petition is not a travel document.
Departure can affect a pending adjustment application and the ability to return. The rules in 8 CFR 245.2(a)(4) distinguish situations involving advance parole and removal proceedings. Have counsel review the complete history and current law before arranging travel, even if a travel document has been issued.
Prepare the next filing carefully
- Keep the I-360 approval and the notice showing the priority date.
- Gather identity and birth records, with required translations.
- Review prior entries, applications, arrests, and court proceedings with counsel.
- Check current I-485 instructions, required medical evidence, photos, filing address, and applicable fees or exemptions.
- Evaluate I-765 and I-131 separately rather than assuming every applicant should request both.
A careful filing review answers whether adjustment is available now and which additional requests are appropriate. Read about our SIJ services or schedule a consultation with the Law Office of Ghenadie Rusu, PLLC.
