Naturalization: Becoming a U.S. Citizen

Naturalization is the process by which foreign individuals become citizens of the United States. It offers individuals the opportunity to participate in the rights and responsibilities of U.S. citizenship fully.

Requirements for Naturalization

To be eligible for naturalization, applicants must generally meet the following requirements:

  1. Age Requirement: Applicants must be at least 18 years old at the time of filing the application.
  2. Permanent Resident Status: Applicants must have lawful permanent resident (LPR) status, also known as having a Green Card, for a specific period of time. Typically, this period is 5 years, but it may be reduced to 3 years for spouses of U.S. citizens or through other qualifying circumstances.
  3. Continuous Residence: Applicants must have continuously resided in the United States for a specified period.
  4. Physical Presence: Applicants must have been physically present in the United States for a certain number of months during the required continuous residence period.
  5. Good Moral Character: Applicants must demonstrate good moral character, which includes factors such as obeying laws, paying taxes, and having a clean criminal record.  Please note that having a criminal record does not necessarily result in an automatic denial of citizenship in the United States. The impact of a criminal record on naturalization can vary depending on the nature and severity of the offense. At the Law Office of Ghenadie Rusu, we will help successfully prove your good moral character.
  6. English Language Proficiency: Applicants must be able to speak, read, write, and understand basic English. Certain exceptions may apply for individuals with disabilities or those who are older and have been permanent residents for a longer period.
  7. U.S. Civics Knowledge: Applicants must pass a civics test to demonstrate knowledge of U.S. history, government, and the rights and responsibilities of citizenship. Study materials and resources are available to help applicants prepare for the test.

The Naturalization Process

The naturalization process typically involves the following steps:

  1. Filing the Application: Applicants must complete and submit the Application for Naturalization, to the United States Citizenship and Immigration Services (USCIS). Along with the form, they must provide supporting documentation and the required filing fee.
  2. Biometrics Appointment: After submitting the application, applicants will be scheduled for a biometrics appointment to provide fingerprints, photographs, and other biographical information.
  3. Interview and Civics Test: Applicants will attend an interview with a USCIS officer. During the interview, they will be tested on their English language skills and knowledge of U.S. civics. In some cases, exemptions or accommodations may be available.
  4. Oath of Allegiance: If the application is approved, applicants attend a naturalization ceremony where they take an Oath of Allegiance to the United States. This oath signifies their commitment to the rights and responsibilities of U.S. citizenship.

Benefits of Naturalization

Becoming a U.S. citizen through naturalization offers numerous benefits, including:

  1. Right to Vote: Citizens have the right to vote in federal elections and have a voice in shaping the country’s future.
  2. Passport and Consular Assistance: Citizens can apply for a U.S. passport, which allows them to travel internationally and seek assistance from U.S. embassies and consulates abroad.
  3. Protection from Deportation: Citizens cannot be deported or removed from the United States unless they obtain citizenship fraudulently or are involved in certain criminal activities.
  4. Eligibility for Federal Jobs and Benefits: Citizens have access to a broader range of employment opportunities and are eligible for certain government benefits and programs.
  5. Ability to Sponsor Relatives: Citizens can sponsor certain family members for immigration benefits, including parents, spouses, and unmarried children.
